These Terms and Conditions govern your access to and use of gonextstepflooring.com, including its pages, forms, content, features, and related online services.

The website is owned and operated by Next Step Flooring Inc., referred to in these Terms as “Next Step Flooring,” “Company,” “we,” “us,” or “our.”

By accessing the website, submitting an inquiry, requesting an estimate, calling us, emailing us, or otherwise using the website, you agree to these Terms. Do not use the website if you do not agree with them.

1. Website Purpose

The website provides general information about our flooring services, service areas, previous work, estimated pricing ranges, and methods for contacting us or requesting an estimate.

Website content is provided for informational purposes only. It does not constitute:

  • A binding proposal or offer

  • A final project estimate

  • A construction or home-improvement contract

  • Engineering, structural, environmental, legal, or professional advice

  • A guarantee that a particular service, material, price, result, or schedule will be available

Submitting a form or contacting us does not create a contractor-client relationship and does not obligate either party to proceed with a project.

2. Services

Services described on the website may include:

  • Hardwood flooring installation

  • Engineered hardwood installation

  • Floor restoration and refinishing

  • Hardwood floor repair

  • Floor leveling

  • Subfloor preparation and repair

  • Flooring demolition and removal

The exact services included in a project will be listed in the written estimate or contract signed by the customer and Next Step Flooring.

We may modify, expand, limit, or discontinue any website-described service at any time.

3. Website Pricing and Cost Estimates

All prices, cost-per-square-foot figures, savings examples, project durations, ranges, and other cost information displayed on the website are general estimates provided for informational and planning purposes only.

Website pricing is not a quote, offer, guarantee, or binding contract price. Actual pricing may be higher or lower.

Project pricing may be affected by factors including:

  • Total square footage

  • Number, size, and layout of rooms

  • Flooring type, species, grade, width, thickness, finish, and manufacturer

  • Material availability, supplier pricing, shipping, and delivery costs

  • Straight-lay, diagonal, border, herringbone, chevron, parquet, or other patterns

  • Existing flooring type and number of flooring layers

  • Adhesive, mortar, fastener, or underlayment removal

  • Demolition difficulty and disposal requirements

  • Subfloor material and condition

  • Floor flatness, slopes, settlement, movement, and structural conditions

  • Moisture levels and required moisture-control systems

  • Rot, mold, mildew, pest damage, leaks, or water intrusion

  • Asbestos, lead, silica, or other hazardous or regulated materials

  • Required subfloor repair, patching, grinding, leveling, or replacement

  • Board repairs, gap filling, stain matching, and custom color work

  • Number and type of finish coats

  • Stairs, landings, closets, transitions, borders, vents, and baseboards

  • Furniture, appliance, equipment, or personal-property moving

  • Occupied-property working conditions

  • Site access, elevators, parking, loading restrictions, and travel

  • Condominium, apartment, commercial, or homeowners-association requirements

  • Building rules, work-hour restrictions, permits, inspections, or approvals

  • Material waste allowances and site-specific cutting requirements

  • Customer-requested changes

  • Conditions that could not reasonably be observed before demolition

  • Taxes, governmental charges, permit fees, and disposal fees

  • Labor, supplier, fuel, and market-price changes

A price becomes binding only when it is included in a written estimate or contract signed by the customer and Next Step Flooring.

4. On-Site Estimates

An on-site estimate is based on conditions that are visible and reasonably accessible at the time of inspection.

Unless expressly included in writing, an estimate does not include:

  • Destructive testing

  • Removal of flooring, walls, baseboards, or building materials for inspection

  • Structural engineering

  • Plumbing or electrical investigation

  • Mold, asbestos, lead, or environmental testing

  • Laboratory testing

  • Inspection of inaccessible or concealed areas

  • Repairs to conditions hidden beneath existing materials

  • Work outside the scope listed in the estimate

Measurements, moisture readings, visual inspections, and preliminary recommendations represent conditions observed at the time of the visit. Conditions may change before or during the project.

5. Written Project Contract

Website Terms do not replace the written contract required for a flooring or home-improvement project.

Before covered work begins, the customer may be required to sign a separate written estimate, proposal, work authorization, or home-improvement contract containing the project-specific terms, including:

  • Customer and property information

  • Scope of work

  • Materials and products

  • Contract price

  • Payment schedule

  • Approximate start and completion dates

  • Warranty terms

  • Exclusions

  • Cancellation rights

  • Required legal notices

  • Change-order procedures

When these Website Terms conflict with a signed project contract, the signed project contract controls with respect to that project.

6. Hidden and Unforeseen Conditions

Flooring conditions are frequently concealed beneath existing flooring, adhesive, underlayment, baseboards, cabinets, appliances, or other building components.

After demolition or work begins, we may discover conditions that were not visible during the original inspection, including:

  • Damaged, loose, deteriorated, or missing subflooring

  • Moisture or vapor problems

  • Rot, mold, mildew, or pest damage

  • Structural movement or framing problems

  • Excessive floor variation

  • Multiple flooring layers

  • Unexpected concrete, mortar, adhesive, fasteners, or reinforcement

  • Plumbing or water leaks

  • Hazardous or regulated materials

  • Conditions that prevent manufacturer-compliant installation

Such conditions are not automatically included in the original price unless expressly stated in the signed contract.

We will explain material concealed conditions and, where additional work is recommended or required, provide a written change order describing the added or removed work, price adjustment, and any expected schedule impact.

Except where immediate action is reasonably necessary to prevent injury or additional property damage, additional work will not be performed without the approvals required by the project contract and applicable law.

7. Change Orders

Changes to the agreed scope, materials, installation method, price, or schedule must be documented in writing when required by the project contract or applicable law.

A change order may be required when:

  • The customer requests different or additional work

  • Selected materials become unavailable

  • Concealed conditions are discovered

  • A manufacturer requires additional preparation

  • Required permits, inspections, or association rules affect the work

  • The customer delays access or preparation

  • Another contractor’s work changes the flooring scope

A change order may increase or decrease the contract price and may affect the project schedule.

8. Material Availability and Natural Variation

Flooring materials may be discontinued, delayed, backordered, damaged in transit, or subject to supplier allocation.

Wood is a natural product. Samples, website images, showroom pieces, and photographs cannot guarantee an exact match. Natural and manufactured flooring may vary in:

  • Color

  • Grain

  • Mineral streaking

  • Knots and character

  • Texture

  • Sheen

  • Board length

  • Pattern

  • Dye lot

  • Shade between production batches

Lighting, screen settings, photography, age, oxidation, and surrounding finishes can also affect perceived color.

Reasonable natural variation is not considered a defect.

9. Existing-Floor Matching

We may attempt to match existing flooring, stain, sheen, board dimensions, grain, or finish. Exact matching may not be possible because of product discontinuation, aging, sunlight exposure, oxidation, previous finishes, wood variation, or unavailable materials.

Any matching recommendation is a professional best effort and not a guarantee of an invisible or exact match.

10. Customer Responsibilities

The customer is responsible for:

  • Providing complete and accurate project information

  • Confirming ownership or authority to authorize work

  • Identifying property-management or homeowners-association requirements

  • Securing approvals not expressly included in our contract

  • Providing safe and timely access to the property

  • Providing electricity, water, ventilation, and other agreed utilities

  • Removing cash, jewelry, documents, electronics, artwork, and valuables

  • Securing children and pets away from the work area

  • Disclosing known leaks, moisture, mold, asbestos, lead, structural problems, and prior damage

  • Informing us of concealed pipes, wiring, radiant heating, security systems, or other installations

  • Following care, curing, ventilation, humidity, and maintenance instructions

  • Preventing other trades or occupants from damaging completed work

Additional charges or schedule changes may apply when the customer does not complete agreed preparations or provide required access.

11. Furniture and Appliances

Furniture or appliance moving is included only when specifically listed in the written estimate or contract.

We may decline to move fragile, oversized, unsafe, connected, valuable, or specialized items, including:

  • Pianos

  • Safes

  • Aquariums

  • Medical equipment

  • Pool tables

  • Built-in furniture

  • Gas appliances

  • Hard-wired equipment

  • Electronics containing sensitive data

  • Items requiring licensed plumbing or electrical work

The customer must disclose unusually heavy, fragile, valuable, or connected items before work begins.

12. Dust, Noise, Odor, and Temporary Disruption

Floor demolition, sanding, grinding, cutting, leveling, staining, and installation may produce dust, vibration, noise, odor, and temporary limits on property access.

Dust-control or dustless equipment significantly reduces airborne dust but does not guarantee a completely dust-free environment.

Customers with allergies, respiratory sensitivities, children, pets, or other health concerns should make appropriate arrangements and consult a qualified medical professional when necessary.

13. Project Scheduling and Delays

Any project start date, completion date, or duration shown on the website or discussed before a signed contract is an estimate only.

Schedules may be affected by:

  • Material availability

  • Delivery delays

  • Weather

  • Moisture and curing conditions

  • Hidden site conditions

  • Customer changes

  • Building access restrictions

  • Permit or inspection delays

  • Supplier or manufacturer delays

  • Labor availability

  • Emergencies

  • Events beyond our reasonable control

We will make reasonable efforts to communicate significant scheduling changes. We are not responsible for delays caused by circumstances outside our reasonable control.

14. Payments and Deposits

Project deposits, progress payments, final payments, financing arrangements, and accepted payment methods will be stated in the signed project contract.

Payment obligations will comply with applicable California contractor and consumer-protection requirements.

The customer may not withhold undisputed payment because of a separate disputed item. Disputed work should be reported promptly so that it can be inspected and addressed under the applicable contract and warranty terms.

15. Cancellations and Rescheduling

Submitting a website inquiry does not obligate the customer to hire us.

Cancellation and rescheduling rules for estimates or project appointments will be communicated when the appointment is made.

Cancellation rights, fees, material-restocking charges, special-order-material obligations, and project-termination procedures will be governed by the signed project contract and applicable law.

Nothing in these Terms limits a cancellation or rescission right that cannot legally be waived.

16. Workmanship and Manufacturer Warranties

Any workmanship warranty applies only when expressly stated in the signed project contract.

Warranty coverage, duration, exclusions, claim procedures, and available remedies will be controlled by that contract.

Manufacturer warranties are provided by the applicable manufacturer and are subject to the manufacturer’s requirements. We do not control and cannot expand a manufacturer’s warranty.

Unless the signed contract states otherwise, warranty coverage does not include problems caused by:

  • Water intrusion, leaks, flooding, or excessive moisture

  • Improper indoor humidity

  • Structural movement or foundation conditions

  • Subfloor conditions outside our contracted scope

  • Normal wear, scratches, dents, fading, or aging

  • Pet damage

  • Misuse, abuse, negligence, or improper maintenance

  • Improper cleaning products or methods

  • Failure to follow curing or care instructions

  • Work performed by another contractor

  • Customer-supplied or defective materials

  • Manufacturer defects

  • Conditions disclosed and excluded in writing

Nothing in these Terms excludes warranties or remedies that cannot legally be excluded.

17. Customer-Supplied Materials

When a customer supplies flooring or other materials, the customer is responsible for product selection, quantity, quality, delivery, suitability, acclimation requirements, warranties, and replacement availability.

We are not responsible for delays, defects, shortages, color variation, damage, or performance problems associated with customer-supplied materials unless caused directly by our installation work.

Additional charges may apply for sorting, handling, returning, replacing, or working with unsuitable or insufficient materials.

18. Hazardous or Unsafe Conditions

We may stop or postpone work when we reasonably believe that a condition may threaten health, safety, property, legal compliance, or proper installation.

Examples include suspected asbestos, lead, mold, active leaks, unsafe electrical conditions, unstable structures, contaminated materials, pest infestations, or inadequate ventilation.

Testing, abatement, engineering, remediation, or licensed specialty work is not included unless expressly listed in the signed contract.

19. Project Photographs

We may photograph or document project conditions for estimating, measurements, quality control, insurance, warranty administration, safety, change orders, and business records.

Interior photographs identifying the property or customer will not be used for public marketing without permission or another valid authorization.

Customers may request that identifying details be excluded from approved marketing materials.

20. Communications

By contacting us, you authorize us to respond through the communication method you used or provided, including telephone or email.

Providing a telephone number through a general inquiry form does not by itself constitute consent to receive automated marketing text messages.

Where a separate text-message opt-in is presented, consent is voluntary and is not a condition of purchasing services. Message and data rates may apply. Message frequency may vary. Reply STOP to opt out and HELP for assistance.

21. Website Content and Intellectual Property

Website text, design, branding, photographs, graphics, logos, videos, layouts, and other content are owned by or licensed to Next Step Flooring and are protected by applicable intellectual-property laws.

You may view the website for personal and noncommercial purposes. You may not reproduce, republish, sell, scrape, modify, distribute, impersonate, or commercially exploit website content without written permission.

22. Prohibited Website Use

You may not:

  • Use the website for unlawful or fraudulent purposes

  • Submit false, misleading, or impersonated information

25. Limitation of Liability

To the fullest extent permitted by law, Next Step Flooring will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of, or inability to use, the website.

This limitation does not apply to:

  • Obligations under a signed project contract

  • Liability that cannot legally be excluded

  • Personal injury or property damage caused by legally actionable conduct

  • Rights and remedies provided by applicable consumer-protection law

26. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold Next Step Flooring harmless from third-party claims arising from your unlawful use of the website, violation of these Terms, submission of content you do not have the right to provide, or infringement of another person’s rights.

This provision does not require a consumer to indemnify the Company for the Company’s own unlawful conduct.

27. Governing Law

These Website Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

Subject to applicable consumer-protection law and any controlling project contract, disputes relating solely to the website may be brought in a court with appropriate jurisdiction in Los Angeles County, California.

28. Changes to These Terms

We may update these Terms to reflect changes in the website, business practices, or legal requirements.

The updated version will be posted with a revised “Last Updated” date. Changes apply prospectively from the effective date unless applicable law requires otherwise.

29. Severability

If any provision is found invalid or unenforceable, it will be enforced to the maximum extent legally permitted, and the remaining provisions will remain in effect.

30. No Waiver

Failure to enforce a provision of these Terms does not waive the right to enforce it later.
